Welcome to the eDiary software service!

These Terms of Service (hereinafter referred to as the "Terms") are a legal agreement between you (the "User") and eDiary (hereinafter referred to as "we", "us", or "eDiary"). By using our software and services, you agree to be bound by these Terms.

1. Service Overview

eDiary is a privacy-focused diary software offering text editing, local encrypted storage, and premium cloud synchronization. Payments for premium services are processed by Creem.io, our authorized Merchant of Record.

2. User Account and Data Security

  • Security: Users are solely responsible for maintaining the confidentiality of their account and passwords. We are not liable for any loss resulting from unauthorized access due to user negligence.
  • Encryption: Cloud data is encrypted using the user's private cloud password as the key. We do not store your encryption keys. If you lose your cloud password, your cloud data will be unrecoverable.

3. AI Writing Assistant Disclosure

eDiary provides an AI writing assistant to help with content creation.

  • Wrapper Disclosure: This feature acts as a custom interface for underlying third-party AI models.
  • Privacy: AI processing is based on user-triggered input. We do not use your private diary entries to train these models.

4. Service Fees and Refunds

  • Pricing: eDiary is free to use. Cloud synchronization and advanced features are available with eDiary Premium.
  • Refund Policy: We want you to be satisfied. If you experience technical issues that prevent the service from functioning as described, or if you made a mistake in your purchase, you may request a refund within 14 days of the transaction.
  • Process: To request a refund, please contact us at [support@ediary.io]. Refunds are processed through Creem.io in accordance with their standard procedures and applicable consumer protection laws.
  • No-Refund Cases: Refunds may be denied if the service has been extensively used or if the request is made after the 14-day window without a valid technical reason.

5. Subscription Management and Cancellation

  • Cancellation: For recurring subscriptions, you can cancel at any time. You can manage or cancel your subscription directly through the eDiary Account Panel or via the Creem Customer Portal.
  • Access: Upon cancellation, you will retain access to premium features until the end of your current billing period.

6. Privacy and Data Protection (GDPR Compliance)

  • We comply with applicable data protection laws (including GDPR where applicable).
  • For payment processing and tax compliance, certain transaction data is shared with our Merchant of Record, Creem.io. Please refer to our Privacy Policy for more details.

7. Content Standards

Users agree not to use eDiary for any illegal, defamatory, or infringing activities. We reserve the right to terminate services for users who violate these standards.

8. Limitation of Liability

To the maximum extent permitted by law, eDiary and Creem.io shall not be liable for any indirect or consequential damages arising from the use or inability to use the service.
